The listings shown above are located in Maui condominium communities that were identified by the Maui County Council's Temporary Investigative Group (TIG) as appropriate candidates for continued short-term vacation rental use and recommended for consideration for rezoning into the newly created H-3 or H-4 Hotel Districts.
This is an important distinction for buyers evaluating Maui short-term rental properties. These condominiums are not currently guaranteed H-3 or H-4 zoning, but they were specifically identified by the County's TIG as properties where continued vacation rental use may be appropriate.

The TIG recommendation also included a number of smaller properties, duplexes and individually identified parcels in Kihei, including 1178 Uluniu Road, 1194 Uluniu Road, 1440 Halama Street, 1444 Halama Street, 1470 Halama Street, 2131 Iliili Road, Indo Lotus Beach House, Kapu Townhouse, Moana Villa, My Waii Beach Cottage and Waiohuli Beach Duplex. These smaller properties may not regularly produce condominium listings and therefore may not appear in the search results above.
Maui County adopted Ordinance 6008 in June 2026, establishing the new H-3 and H-4 Hotel Districts. These districts were designed to provide a potential zoning pathway for certain properties historically operating legal transient vacation rentals in the A-1 and A-2 Apartment Districts.
Generally, eligible A-1 properties may transition to H-3 zoning and eligible A-2 properties may transition to H-4 zoning. The new districts largely retain the underlying development standards of their corresponding apartment districts while allowing qualifying transient vacation rental use.
The H-3/H-4 legislation itself did not automatically rezone any condominium. Individual properties must still go through the applicable change-in-zoning and, where necessary, community-plan amendment process.
Before Bill 9 was adopted, the Maui County Council formed a Temporary Investigative Group to examine which apartment-zoned properties should potentially be allowed to continue operating as short-term rentals.
After its review, the TIG issued a final report on October 14, 2025. Exhibit 2 of that report identified properties the TIG believed were appropriate candidates for continued transient vacation rental use and recommended Council-initiated changes in zoning to H-3 or H-4 once those districts were established.
The County has stated that approximately 4,519 units were included in the TIG recommendation.
For a prospective buyer, inclusion in Exhibit 2 is therefore a meaningful positive factor when evaluating regulatory risk. It demonstrates that the property was specifically identified through the County Council's review process as a candidate for continued short-term rental use.
It is not, however, an approval or guarantee.
With H-3 and H-4 zoning now established, Maui County has begun the next phase: considering individual properties for actual rezoning.
The first Council-initiated rezoning measures began moving forward in the summer of 2026 through Resolutions 26-110 and 26-111. Those proceedings involve selected properties from the broader universe of apartment-zoned vacation rentals, and the property lists have already been amended during the legislative process.

This distinction is important when comparing Maui condominium properties.
Bill 9, now Ordinance 5909, phases out transient vacation rental use in Maui's apartment districts on different schedules.
For affected properties in the West Maui Community Plan area, the current phase-out date is December 31, 2028.
For affected apartment-zoned properties elsewhere in Maui County, the current phase-out date is December 31, 2030.
A property that successfully obtains appropriate hotel zoning or otherwise qualifies to continue transient vacation rental use would not rely on the former apartment-district vacation rental allowance after the applicable phase-out date.
